Purchasing Agreement

The direct purchase of Silver Owl CBD Company products from the manufacturer is strictly dependent upon the provision of consent to the Terms of Use detailed in this Purchasing Agreement; adherence to the Silver Owl CBD Company’s general Terms of Use found here; and the acceptance of all terms listed in this Purchasing Agreement and the aforementioned Terms of Use by the purchasing party (hereby referred to as ‘you’). By purchasing any Silver Owl CBD Company (hereby referred to as ‘ Company’) product(s) and confirming you’ve read and agree to all Terms Of Use, you acknowledge and consent to the following conditions:

You hereby confirm that you are a resident of the United States, twenty one (21) years of age or older, placing an order destined for a valid address in the United States, and will be receiving this order directly.

You hereby confirm that you are submitting with your express consent payment to the Company via legitimate means (i.e. in ways that cannot be construed as fraudulent or using stolen funds) and acknowledge that the Company may seek prosecution and restitution to the greatest extent allowed by the law if you submit an illegitimate payment to us for goods provided and/or services rendered.

You hereby confirm that any information you have provided the Company is factually correct; that any products received are intended for exclusive use by the party consenting to these Terms of Use; and that by providing the Company’s products to any other, unintended parties whose use is not explicitly covered by the agreement to these Terms of Use, you will be assuming the responsibility for their use of the Company’s products and any resulting consequences accumulated by you or any unintended parties.

You hereby release, waive, discharge, and covenant not to sue the Silver Owl CBD Company, Number One Distro or any of their representatives from liability from any and all claims resulting in personal injury, accidents, illnesses (including death), loss of property, criminal prosecution, gross misuse, use by unintended parties (i.e. any individual other than the original purchasing party such as a minor or pet); or any injury, accidents, illnesses, loss of property or criminal charges accumulated by unintended parties as a result of being exposed to the Company’s products through no fault of its own.

You hereby expressly agree to indemnify and hold the Company and its representatives harmless from any and all liabilities, claims, suits, actions, procedures, costs, expenses, damages and/or legal fees brought as a result of your purchase, use and/or misuse of our products, or the use and/or misuse of the Company’s products by unintended parties whom you provided access to these products, either deliberately or unintentionally.

You hereby expressly agree to be held fully liable, legally and financially, to the greatest extent allowed by the law for any damages accumulated by the Company, including to its reputation, as a result of your use, misuse or provision of our products to any unintended parties.

You hereby expressly agree to the foregoing waiver and assumption of risks agreement outlined by these Terms of Use is intended to be as broad and inclusive as is permitted by the law of the State of Colorado that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect.

You hereby expressly agree that you have read the waiver of liability, assumption of risk, and indemnity agreement included in these Terms of Use, fully understand and agree to the conditions stated above, and understand that you are giving up substantial rights, including the right to sue. You acknowledge and agree that the direct purchase of our products, the reading of and agreement to these Terms of Use binds you in covenant to the conditions listed therein; that you are purchasing the Company’s products and agreeing to these Terms of Use freely and voluntarily with no compulsion of influence; and intend your completion of the purchasing process to be a complete and unconditional release of all liability to the greatest extent allowed by law.

By checking the relevant box on the final page of the ordering process, you acknowledge that you have read this Purchasing Agreement and the Company’s Terms of Use; and you agree, under neither coercion nor influence, to the conditions of purchasing the Company’s products as stated above, and to its Terms of Use.
