Delta 8 And You: FAQs
Of all the hemp derived cannabinoids that have gotten popular over the past couple years, the most intriguing might be Delta 8 THC– or as it’s more commonly referred to, Delta 8. It’s certainly unlike any compound we’ve ever worked with for our products!
We’ve already fielded numerous questions about Delta 8 before getting a chance to write this article, so we’d like to share our answers with you. We’ve already seen Silver Owl Delta 8 products take off, with our first batch selling out in under 48 hours of their release.
As this cannabinoid increases in popularity nationwide, you might consider trying it; we hope we can shed some light on it before you do!
Here are some of the most frequently asked questions we’ve answered lately:
“Is Delta 8 Psychoactive?”
Yes. Delta 8 is an analog of the cannabinoid Tetrahydrocannabinol (THC) and shares many of its effects with the federally illegal compound, Delta 9 THC. As such, it will provide a very similar “high”. However, its effects are much shorter in duration and lack the propensity for inducing anxiety and paranoia commonly observed with the use of Delta 9.
Due to its psychoactivity, we must insist that you enjoy the use of the Delta 8 compound responsibly. Please do not use Delta 8 prior to operating any vehicles or heavy machinery. You could be rightfully subjected to a DUI or OWI charge and nobody wants that!
“Will Delta 8 cause me to fail a drug screening?”
Most likely, yes- though it really depends on the method of screening used. Most tests will signal the presence of any form of THC in the body as a blanket positive, so please don’t use Delta 8 products if failing a screening is of concern to you.
“Is Delta 8 legal?”
It depends. For Delta 8 to be considered legal anywhere, it has to be derived from industrial hemp. The 2018 Farm Bill federally legalized nonpsychoactive hemp and its derivatives, but did not apply to psychoactive cannabis and its derivatives. So while hemp derived Delta 8 is legal on the federal level, cannabis derived Delta 8 remains highly illegal.
State legislation supersedes federal law in the case of Delta 8. While we have yet to see any new regions move to ban this compound, it is illegal in some states. This boils down to the terminology used in each state’s legal code: while some states explicitly banned Delta 9 THC, some banned “THC”- and this blanket statement makes all the difference here.
Unless their codes change, we will not be able to sell or ship Delta 8 products to end users and businesses in the following states: Alaska, Arizona, Arkansas, Colorado, Delaware, Idaho, Iowa, Mississippi, Montana, Rhode Island and Utah.
“Aren’t you based in Colorado? How does that work?”
The Silver Owl CBD Company possesses all of the certifications necessary to manufacture and nationally distribute hemp and its derivatives, including Delta 8 THC. Unfortunately, Colorado’s legal codes refer to THC in the blanket context and make things tricky for us.
In order to sell our Delta 8 line here, we’d have to sell it directly to dispensaries. This would require us to get a number of additional certifications as a cannabis company, which in turn would prevent us from selling any of our products directly to any end users or any entities outside of Colorado.
This would effectively limit our opportunities to provide Americans with much-needed alternatives- it would also prevent us from establishing and maintaining relationships with payment processing companies, banks and investors, which would leave us dead in the water.
“Will Delta 8 interact with my prescription medications?”
Unfortunately, we don’t have any conclusive research into interactions between Delta 8 and various pharmaceuticals at this time. So while we can’t say for sure, we can provide a subjective rule of thumb: if Delta 9 THC is known to interact with any medications you’re taking, it’s safe to assume that Delta 8 will produce similar results.
“Should I avoid using Delta 8?”
In most cases, it’s not our place to tell you whether you should or shouldn’t be using Delta 8 THC. As we mentioned earlier, under no circumstances should you ever use Delta 8 products and operate any vehicles or heavy machinery- and like all Silver Owl products, our Delta 8 line is not to be used by anyone under the age of 21.
Beyond that, please consider avoiding the use of Delta 8 products:
-If you are pregnant or breastfeeding;
-If you have or suspect you have any known or unknown heart, heart rate, blood pressure, eye pressure or similar health concerns, as THC in any form is known to affect these conditions;
-If you are at risk of developing any of the aforementioned conditions;
-If you have ever had any adverse reactions to hemp or its derivatives;
-Or, as mentioned earlier in this article, if you are concerned about your ability to pass a urinalysis or other drug screening, as Delta 8 will likely register as Delta 9 and produce a positive result on most tests.
“Do I need a prescription to use Delta 8?”
No- though it’s always wise to consult a physician or other certified medical professional prior to using any new substance for the first time. Delta 8 products are available for personal, private, recreational use in states where they are currently legal for both purchase and possession.

Delta 8 is certainly not for everyone, but it’s a wonderful addition to the list of cannabinoids available across the country and has the potential to help countless Americans live happier, healthier lives- which is the crux of everything we do as people and as a company.
Due to its psychoactive nature, there’s a real potential for the responsible use of hemp derived Delta 8 by adults 21 years of age or older to contribute to a shift in public perceptions towards its prohibited counterpart. Beyond looking out for your safety and the safety of others, the notion that Delta 8’s users could contribute to national legalization efforts is a major reason why we must implore you to use Silver Owl Delta 8 products respectfully and responsively.
